How to sell a flat in Gandhinagar: documents and steps
The papers you need, the order to do them in, and where most sales slow down.
Which documents do you need to sell a flat?
Start with your registered sale deed. It proves you own the flat. A share certificate from the society shows membership, but it does not prove ownership on its own. Keep the latest encumbrance certificate close by too. The Housing.com checklist for selling property lists the rest.
Most sellers also collect:
- A no-dues certificate. It shows the society charges are paid up.
- A clearance letter from the bank, if the flat was mortgaged.
- Current property tax and utility receipts.
- PAN for you and the buyer. PAN is required to register a sale above Rs 10 lakh.
Do you need a society NOC?
In most housing societies, yes. The NOC confirms the society has no objection to the transfer and that dues are cleared. The Assetly guide to society NOCs for flat sales explains how the request works. Buyers usually ask for it too, because banks often want the NOC before they release a home loan.
Apply early. Society approvals can take several weeks. Your society sets its own transfer fee.
How does registration work in Gujarat?
The sale deed must be stamped and registered with the Sub-Registrar. Stamp duty and registration fees are set by the state and calculated on the higher of the agreement value or the government valuation. Rates change, so check the current figure before you budget. The Bajaj Housing Finance note on Gujarat stamp duty and registration gives an overview, and the official portal and your Sub-Registrar office give the final rate.
The deed is registered in person. Both parties sign in front of the registrar, and biometric verification is taken. Book the slot early, because appointments fill up.
What order should you follow?
- Clear all society dues and get the no-dues certificate.
- Apply for the NOC and the membership transfer. Pay any transfer fee.
- Pay stamp duty, then register the sale deed.
- The society transfers the share certificate to the buyer.
- The buyer updates property tax records.
Will you owe tax on the sale?
It depends on how long you held the flat and what you do with the money. The rules are technical and change from time to time. Ask your CA before you agree a price, not after you have signed.
Why do flat sales stall?
Most stalls come from papers that are missing or do not match. A pending society due, an old loan that was never closed, or a deed with the wrong name can each hold up a sale for weeks. Check the papers before you list the flat.
